TERMS AND CONDITIONS OF RENTAL OF MACHINES OF ZRK-DOM IN POZNAŃ SP. Z O.O. 1. The Lessor - Zakład Robót Komunikacyjnych - DOM in Poznań sp.z o.o. 2. Lessee - a business entity renting a machine from the Lessor. 3. Construction - location of works for the Lessee. 4. You need JavaScript enabled to view it.; fax (61) 6333659, mobile phone 797 703 251. 5. The machines are rented for a minimum of 5 hours a day. 1). The Lessee will be charged for a minimum of 5 hours a day if the equipment work reports show a smaller number of hours as confirmed by the Lessee. 2). If the rental time exceeds 5 hours a day, the Lessee will be charged with the actual number of hours. 3). Waiving the requirement to rent a machine for a min. of 5h, is possible only in consultation with the Lessor and only in particularly justified cases. 4). The daily rental period cannot exceed 12 hours. 5). The rental time referred to in point 4 does not include the time of the transport, referred to in point 14, sub-point a. 6). The machines that are the subject of the lease are rented together with the Lessor's properly trained and prepared full-time service - without surveying service. 7). The Lessee is obliged to prepare the track for the operation of the machine being the subject of the lease (disassembly and assembly of equipment in the track, preparation of the track for tamping, disconnecting the voltage in the traction network, etc.).
8). The unit rental price of the machine specified in the offer - the machine rental price list includes fuel costs. 9). If it is necessary to work with the machines at night, and/or on Saturday, Sunday and/or public holidays, the unit net rental cost will be increased by a factor of 1.30. 10). The increase in the unit rental cost referred to in point 9 applies only to the operation of machines from 1 hour of machine operation at night, and/or on Saturday, Sunday and/or holidays. 11). The rental machines are equipped with all necessary consumables. 12). In the case of renting the machines for a longer period, when it will be necessary to refuel, the Lessee is obliged to deliver fuel in the amount required to complete the rental, in a manner ensuring the continuity of the machine's operation. 13). In the event of the circumstances referred to in point 12, the Lessee, together with the Lessor's representative (machine operator), on the date of the end of the lease, prepare a written confirmation of the amount of fuel provided, along with a photocopy of the original invoice for the fuel purchased by the Lessee, on the basis of which the Lessee will issue a re-invoice for the value of the fuel delivered. 14). The total rental price will consist of: (a) transport - travel from the base or the current parking place - machine work, to the Lessee's work site and back to the Lessor's base or to the Lessor's previous work location, (b) shunting works after arrival to the construction site and detaching and securing of the machine and service wagons, (c) preparation of the machine for work and travel, (d) effective work, (e) accessing and exiting the construction site, (f) the machine being at the Lessee's disposal, including due to technological breaks, bad weather conditions, no work front, failure to prepare the work site in accordance with point 7, etc.
15). Transport - transfer of machines: (a) charges for transport of the machines will be calculated based on the price indicated in the offer. 16). Rates for the rental of machines: (a) shunting work after the machine has been transported to the construction site, related to the detaching and securing of the machine and service wagons, and effective work - including machine accessing and exiting the construction site - cost according to the rate for effective work, preparation of the machine for work and travel - cost at the rate as for effective work, (c) machine and operator service at the Lessee's disposal - cost at the rate as for effective work. 17). If the terms of the offer are accepted, the Lessee is obliged to issue an order and then make a prepayment in the amount of 50% of the minimum amount for the work of the equipment (without travel); in addition, the remaining terms of the rental of machines also apply to each rental of the equipment. 18). The Lessor - the person indicated in the offer - will be responsible for the coordination of activities related to the delivery of the machine to the construction site and its collection from the construction site. 19). The coordinator of the machine's operation on the construction site will be the Lessee. 20). The Lessee, at his own expense, provides the Lessor's employees with: access to toilet, water, electricity, access to/from the place of work, and also secures at his own expense the tracks for parking the Lessor's wagons and machines. In special cases, when it is not possible to accommodate the Lessor's employees in the Lessor's technical and economic wagons, the Lessee at his own expense provides accommodation that meets the above-mentioned social conditions. 21). The Lessee, at his own expense, provides supervision of the machines after the end of work. 22). In particularly justified cases, the Lessor reserves the right to present an individual offer, in deviation from these rental rules, of the machine rental price list applicable in the Company and the goods tariff. 23). In terms of operator service, the Lessee is obliged to comply with the labour code. 24). The Lessee may not, without the prior written consent of the Lessor, transfer the liabilities resulting from the performance of the contract - orders for the rental of machines to third parties. 25). The Lessee may not, without the prior written consent of the Lessor, set off his claims against the Lessor for any reason with the Lessor's claims resulting from the performance of the contract - ordering the rental of machines. 26). These rental rules apply from June 1, 2016.
